Terms of Service

1. The agreement

These Terms of Service ("Terms") form an agreement between you and Rayon Games, MB ("StatsGoblin", "we", "us", "our"), a company registered in Lithuania. They govern your access to and use of the StatsGoblin website and dashboard (the "Service"), together with our Privacy Policy, which is incorporated by reference. By accessing or using the Service, you accept and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

StatsGoblin provides market-intelligence estimates about game-server ecosystems — player counts over time, market share, movement, and derived analyses such as seasonal comparisons. The figures are estimates derived from publicly available data and statistical methods, and are shown for informational purposes only. We may add, change, or discontinue features and data at any time, and we do not commit to any particular scope of data or coverage.

The Service relies on third parties — Google and Discord for sign-in, Stripe for billing, and the platforms whose public data we analyze. Their availability and conduct are outside our control, and we are not responsible for them.

3. Accounts and eligibility

You must be at least 16 years old and capable of entering into a binding contract to use the Service. If you use the Service on behalf of a company or other entity, you represent that you are authorized to bind that entity, and "you" then refers to that entity. You sign in through Google or Discord; you are responsible for everything that happens through your account and for keeping your sign-in provider account secure. You agree to provide accurate information when you use the Service and to select only the audience category that actually applies to you.

4. Plans and billing

The Service offers a Free plan and a paid Pro plan. Prices and plan contents are shown on the pricing page and may change in accordance with Section 11. Pro is billed on a recurring monthly or annual basis, in advance, through our payment processor (currently Stripe); you authorize recurring charges until you cancel. You can cancel at any time through the billing settings; cancellation takes effect at the end of the current billing period, and you keep access until then. Fees are exclusive of taxes unless a price is stated to include them; applicable taxes (such as VAT) will be added where required.

We do not provide refunds or credits for partial billing periods, unused time, or downgrades, except where required by law.

EU/EEA consumers — statutory withdrawal. If you are a consumer habitually resident in the EU or EEA, you have a statutory right to withdraw from a paid subscription within 14 days of purchase, without giving a reason; to withdraw, contact us through the contact page. By completing a purchase, you expressly request that we begin supplying the Service immediately, and you acknowledge that once access to the paid features has been enabled for you, you lose the right to withdraw. Where the law does not permit that loss, you must pay a proportionate amount for what has been supplied.

5. Acceptable use

You may use the Service only for its intended purpose and in compliance with the law. You must not:

  • copy, extract, scrape, or harvest the Service or its data by automated or manual means, or attempt to do so;
  • sell, sublicense, redistribute, publish, or otherwise make available to any third party any data, estimates, or visualizations from the Service, beyond your own internal business reference;
  • use the Service, or anything obtained from it, to build, train, benchmark, or improve a competing product or service;
  • modify, decompile, or reverse engineer the Service, except to the extent such a restriction is prohibited by law;
  • interfere with or disrupt the Service, probe or test its vulnerabilities, bypass access controls or plan limits, impersonate another person, or use another person's account;
  • use the Service for any unlawful purpose, or in a way that infringes the rights of others.

You may not use figures from the Service to harass, threaten, or harm any person or business.

6. Intellectual property

The Service — including the underlying datasets, analytical methods, visualizations, and software — is owned by us and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms. No ownership is transferred to you, and all rights not expressly granted are reserved. "StatsGoblin" and its associated logos are our marks; you may not use them without our prior written permission. If you send us suggestions or feedback about the Service, you grant us a worldwide, royalty-free license to use and incorporate that feedback without obligation to you.

7. Estimates and reliance

All figures presented by the Service are estimates. They may be incomplete, delayed, or wrong, and they may change as our methods and data change. The Service does not provide financial, investment, business, legal, or other professional advice, and it does not warrant any outcome for your server or business. Any decision you make based on the Service — including spending money, launching, expanding, or closing a server — is yours alone and at your own risk.

8. Disclaimers

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available", with all faults and without warranty of any kind, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or free of errors, that data will be preserved, or that historical coverage for any particular server, market, or region will exist or continue.

Nothing in these Terms excludes, limits, or modifies any warranty, guarantee, right, or remedy you have as a consumer under mandatory provisions of applicable law (including, for EU consumers, Directives 2011/83/EU and (EU) 2019/770) that cannot lawfully be excluded, limited, or modified.

9. Limitation of liability

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, data, or goodwill, arising out of or related to the Service or these Terms, even if advised of the possibility of such damages. To the fullest extent permitted by applicable law, our total aggregate liability arising out of or related to the Service or these Terms will not exceed the greater of (a) the amounts you have paid us for the Service in the 12 months preceding the event giving rise to liability, or (b) €50 if you have paid us nothing.

We do not exclude or limit liability where the law does not allow exclusion or limitation — including liability for intentional wrongdoing, gross negligence, or death or personal injury caused by negligence, or any other liability that cannot be excluded or limited as a matter of law.

10. Indemnification

To the fullest extent permitted by applicable law, you will indemnify, defend, and hold us — and our officers, members, and employees — harmless from any claim, demand, damage, loss, or expense (including reasonable legal fees) brought by a third party arising out of or related to your breach of these Terms, your unlawful use of the Service, or your infringement of any third-party right. This Section does not apply to consumers to the extent the law does not allow it.

11. Changes to the Service or these Terms

We may modify the Service and these Terms from time to time. The current Terms are posted on this page, identified by the "Last updated" date. If a change materially reduces what you are entitled to and you have a paid plan, we will give reasonable advance notice before it takes effect. If you do not agree with a change, you may stop using the Service and, if you are a consumer, cancel your subscription; continuing to use the Service after a change takes effect means you accept it. Prices may change for renewal periods, never retroactively for a period already paid.

12. Term and termination

These Terms apply from your first access to the Service until terminated. You may stop using the Service and close your account at any time; a paid subscription runs until the end of the period already paid for. We may suspend or terminate your access at any time, with or without notice, if you breach these Terms, if required by law, or where we consider continued access to pose risk to us or to other users. On termination, the license in Section 6 ends; Sections 5 through 15 survive.

13. Governing law and disputes

These Terms, and any dispute arising from them or the Service, are governed by the laws of Lithuania, without regard to conflict-of-laws rules, and the courts of Vilnius, Lithuania have jurisdiction. Before filing a claim, you agree to attempt informal resolution through the contact page, allowing at least 30 days for a response.

If you are a consumer, nothing in this Section deprives you of the protection of the mandatory provisions of the law of the country of your habitual residence (Article 6, Rome I), or limits your right — where applicable law so provides — to bring proceedings in the courts of the EU member state in which you are domiciled (Article 18 of Regulation (EU) 1215/2012); nor may we bring proceedings against you as a consumer other than in the courts of your member state of domicile. Any out-of-court consumer redress available to you under applicable law is unaffected.

14. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us concerning the Service and supersede all prior understandings about it. If any provision is held unenforceable, it will be enforced to the fullest extent permitted and the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or a successor in interest. We are not liable for any failure or delay caused by events beyond our reasonable control. Questions about these Terms are welcome through the contact page.
